2. How we protect and retain your Personal Data

We have implemented appropriate technical, organizational and security measures designed to protect your Personal Data. We limit access to your Personal Data only to employees who need to have access to such information in order to provide you all the activities related to the Services and / or Products. However, please note that we cannot guarantee that the information will not be compromised as a result of unauthorized penetration to our servers. As the security of information depends in part on the security of the computer, device or network you use to communicate with us and the security you use to protect your user IDs and passwords, please make sure to take appropriate measures to protect this information.

Your Personal Data will be stored until we delete the record and we proactively delete it or you send a valid deletion request. Videos and photos uploaded for the purpose of  our Product and Services are kept for up to one week and then deleted. We retain Personal Data that you provide to us where we have an ongoing legitimate business need to do so (for example, as long as is required to contact you about our Products and / or Services).

When we have no ongoing legitimate business need to process your Personal Data, we securely delete the information or anonymize it or, if this is not possible, then we will safely store your Personal Data and isolate it from any further processing until deletion is possible.

If you have elected to receive marketing communications from us, we retain information about your marketing preferences for a reasonable period from the date you last expressed interest in our content, Products, and / or Services, such as when you last opened an email from us or ceased using our Products or Services.

At any time, you have the ability to opt out and unsubscribe from receiving marketing communications from us, either changing your e-mail preferences or using the link provided at the bottom of each email message. You may not opt out of administrative emails (for example, emails about your transactions or policy changes) while you are a registered user. You can opt out by

3. How we share your Personal Data

Beamr does not share, distribute, sell or rent any of your Personal Data with/to third parties, except in the following circumstances:

1. To the extent necessary, if the information is required by law in order to prevent, investigate, or take action regarding illegal activities, situations involving potential threats to physical safety, rights, property or of any person, suspected fraud and violations of our Terms of Use. In addition, We will share information in respond to legal process, court orders, subpoenas, or to establish or exercise our legal rights or defend against legal claims.

2. For the purpose of providing and operating our Sites, Services and /or Products, we may share information with trusted third-party partners who need to know for purpose of providing the Service to you. We will require that these third parties comply with this Privacy Policy.

3. In the event that we are acquired by, or merged with, a third party entity, or in the event of bankruptcy or a comparable event, we reserve the right to transfer, disclose or assign your Personal Data in connection with the foregoing events, including, in connection with, or during negotiations of, any merger, sale of company assets, consolidation or restructuring, financing, or acquisition of all or a portion of our business by or to another company. 

4. When we share information with our vendor partners or other partners in order to provide you with our Products and/or Services. 

5. We may also share Personal Data with our affiliated companies.

6. When you have provided your consent to us sharing or transferring your Personal Data (e.g., where you provide us with marketing consents or opt-in to optional additional services or functionality).

7. When you purchase the Products through our Sites you will be redirected to one of our third party partners, Fastspring. In order to purchase the Software in our Vendor Partners websites you will need to provide them with details such as your credit card number, CVV number, its expiration date and any other details needed in order to facilitate the transaction. The websites of our Vendor Partners have different privacy policies and we urge you to review these as well. We are not responsible for any information provided to our Vendor Partners and we do not receive any payment details (such as credit card numbers) from them. 4. International Transfers

Our Service may be provided using resources and servers located in various countries around the world. Therefore your personal data may be transferred across international borders outside the country where you use our Service, including countries that do not have laws providing specific protection for personal data or that have different legal rules on data protection. 

Where we transfer your Personal Data outside of EU/EEA (for example to third parties who provide us with services), we will generally obtain contractual commitments from them to protect your Personal Data. When we engage in such transfers of personal data, we rely on i) Adequacy Decisions as adopted by European Commission on the basis of Article 45 of Regulation (EU) 2016/679 (GDPR) (for example, when we access from Israel), or ii) Standard Contractual Clauses issued by the European Commission. We also continually monitor the circumstances surrounding such transfers in order to ensure that these maintain, in practice, a level of protection that is essentially equivalent to the one guaranteed by the GDPR.

5. Third-Party products and / or services

We enable you to interact with third party websites, mobile software applications and products or services that are not owned or controlled by us (each a “Third Party Service”). We are not responsible for the privacy practices or the content of such Third Party Services. Please be aware that Third Party Services can collect Personal Data from you. Accordingly, we encourage you to read the terms and conditions and privacy policies of each Third Party Service.

6. Your Privacy Rights and how to Change or Delete Your Account

The following rights (which may be subject to certain exemptions or derogations) shall apply to certain individuals (some of which only apply to individuals protected by the GDPR):

1. You have a right to access Personal Data held about you. Your right of access may normally be exercised free of charge, however we reserve the right to charge an appropriate administrative fee where permitted by applicable law;

2. You have the right to request that we rectify any Personal Data we hold that is inaccurate or misleading;

3. You have the right to request the erasure/deletion of your Personal Data (e.g. from our records). Please note that there may be circumstances in which we are required to retain your Personal Data, for example for the establishment, exercise or defense of legal claims;

4. You have the right to object, to or to request restriction, of the processing;

6. You have the right to data portability. This means that you may have the right to receive your Personal Data in a structured, commonly used and machine-readable format, and that you have the right to transmit that data to another controller;

Please note that there may be circumstances in which we are entitled to continue processing your data, in particular if the processing is required to meet our legal and regulatory obligations. Also, please  note that the withdrawal of consent shall not affect the lawfulness of processing based on consent before its withdrawal;

9. You also have a right to request certain details of the basis on which your Personal Data is transferred outside the European Economic Area, but data transfer agreements and/or other details may need to be partially redacted for reasons of commercial confidentiality;

You have a right to lodge a complaint with your local data protection supervisory authority (i.e., your place of habitual residence, place or work or place of alleged infringement) at any time or before the relevant institutions in your place of residence. We ask that you please attempt to resolve any issues with us before you contact your local supervisory authority and/or relevant institution.

You may use an authorized agent to submit a request on your behalf if you provide the authorized agent written permission signed by you. To protect your privacy, we may take steps to verify your identity before fulfilling your request. Subject to legal and other permissible considerations, we will make every reasonable effort to honor your request promptly in accordance with applicable law or inform you if we require further information in order to fulfil your request. When processing your request, we may ask you for additional information to confirm or verify your identity and for security purposes, before processing and/or honoring your request. We reserve the right to charge a fee where permitted by law, for instance if your request is manifestly unfounded or excessive. In the event that your request would adversely affect the rights and freedoms of others (for example, would impact the duty of confidentiality we owe to others) or if we are legally entitled to deal with your request in a different way than initial requested, we will address your request to the maximum extent possible, all in accordance with applicable law.

All registered users may review, update or correct the Personal Data provided in their registration or account profile by changing their user preferences in their account. If you choose to opt out entirely, then your account may become deactivated and you will need to re-register should you decide to opt-in again. If you terminate your account, any association between your account and Personal Data we store will no longer be accessible through your account. 

7. Log Files and Analytic tools

Our Products may collect information regarding the use of the Products, such as the number, resolution and file size of optimized photos/ videos in each session and overall, statistics of pressing different buttons in the app, errors and failures. This information is sent to third party service providers which analyze and integrate this information. We use this information to improve our Products and our Services. 

We use log files. We use such information to analyze trends, administer the Sites, track users’ movement around the Sites, and gather demographic information.

• Databox. The Sites use a tool called "Databox" in order to provide you with the Services. Databox's use of your Personal Data is further described in their privacy policy which is available at https://databox.com/privacy-policy. 

• Google Suite. The Sites use a tool called “Google Suite”. Google’s ability to use and share information collected by Google Suite about your visits to the Sites is restricted by the Google Privacy Policy, available at http://www.google.com/policies/privacy/. • Hotjar. The Sites use Hotjar in order to better understand our users’ needs and to optimize this service and experience. Hotjar is a technology service that helps us better understand our users experience (e.g. how much time they spend on which pages, which links they choose to click, what users do and don’t like, etc.) and this enables us to build and maintain our service with user feedback. Hotjar uses cookies and other technologies to collect data on our users’ behavior and their devices. This includes a device's IP address (processed during your session and stored in a de-identified form), device screen size, device type (unique device identifiers), browser information, geographic location (country only), and the preferred language used to display our Sites. Hotjar stores this information in a pseudonymized user profile. Hotjar is contractually forbidden to sell any of the data collected on our behalf. 8. Specific Provisions Applicable Under California Privacy Law

Our California Do Not Track Notice (Shine the Light). Do Not Track (“DNT”) is a privacy preference that users can set in certain web browsers.  Please note that we do not respond to or honor DNT signals or similar mechanisms transmitted by web browsers.

California Civil Code Section 1798.83 permits our customers who are California residents to request certain information regarding our disclosure of Personal Data to third parties for their direct marketing purposes. To make such a request, please send an email to support@beamr.com. Please note that we are only required to respond to one request per customer each year.

9. Policy Towards Children

This Site is not directed to children under 18. We do not knowingly collect Personal Data from children under 18. If you believe that we might have any such Personal Data, please contact us at support@beamr.com. For the purposes of the GDPR, we do not intend to offer information society services directly to children. In the event that we become aware that you provide Personal Data is in violation of applicable privacy laws, we reserve the right to delete it.
